The family of the late Samuel Mutua Kivuitu, former Chairman of the Electoral Commission of Kenya, has been ordered by the High Court to resolve their dispute over his vast estate through negotiations.
Justice Stephen Riechi ruled that Kivuitu’s widow, Priscilla Ndululu, and her stepchildren must compile a comprehensive list of properties they mutually agree to share, while setting aside those still in contention for further deliberation.
Court Directs Family to Settle Property Dispute
Kivuitu, who passed away in 2013, left behind a complex inheritance battle involving his second wife and children from both his marriages. His first wife, Mary Ann Matanu Kivuitu, and their children are also claiming a stake in the properties, complicating the process.
The court’s directive comes after years of wrangling, with both sides laying claim to significant assets, including prime land and commercial properties. The judge emphasized the importance of an amicable resolution before resorting to legal enforcement.
